H-2B work visa
According to US immigration law, if you wish to temporarily work in the United States as a nonimmigrant, you must obtain a specific visa, depending on the type of work you perform.
The H-2B visa is valid for 6-10 months and can be extended.
Most temporary work visa categories require a potential employer or agent to file a petition, which must be approved by U.S. Citizenship and Immigration Services (USCIS), before applying for a work visa.
All applicants applying for H-2B visas must have a petition approved by USCIS. The petition, Form I-129, must be approved before applying for a work visa at the Embassy. Once the petition is approved, your employer or agent will receive a Notice of Action, Form I-797, which serves as evidence of the petition’s approval. The consular officer will verify the approval of your petition during your interview through the Department of State’s Petition Information Management System (PIMS).
To verify the petition’s approval, you must bring your I-129 petition receipt number with you to your interview at the U.S. Embassy. Please note that the petition’s approval does not “guarantees the issuance of a visa if it is determined that you are ineligible for a visa under U.S. immigration law.”
The process of applying for a non-immigrant work visa to the United States (H-2B) consists of several important steps. The first two (filing the I-129 petition with the U.S. Citizenship and Immigration Services and legal support during the signing of the applicant’s agreement with the employer) are handled by our office in the United States.
What is this for?
The H-2B visa is a temporary non-immigrant visa, and therefore the application process and requirements are virtually identical to those of other non-immigrant visas. Certainly, the refusal rate for this visa is significantly lower than, say, for B-2 visitor and tourist visas. However, there are still certain selection criteria that applicants must meet.
The main one is to prove to the visa officer that the applicant for an H-2B non-immigrant temporary visa for unskilled labor has no desire to immigrate to the United States and has sufficiently strong ties to their home country.
The quota provided by our American employer partners and submitted for approval to USCIS is very small, only 20 people for each of the listed occupations. This is why it is important to approach the entire process very seriously.
What occupations qualify for an H-2B work visa?
Currently, U.S. employers have filed I-129 petitions with the U.S. Citizenship and Immigration Services (USCIS) for approval. The stated quota is 20 positions for each of the following occupations:
Construction Worker (certificate of professional qualification)
Auto Mechanic (certificate of professional qualification)
Plumber (certificate of professional qualification)
Office Clerk (strong English proficiency, computer proficiency, office work experience, certificate of professional qualification)
IT Computer, Database Data Entry (strong English proficiency, computer proficiency, certificate of professional qualification)
The H-2B visa allows foreign workers to earn more than they would in their home country. The H-2B nonimmigrant visa allows U.S. companies to hire foreign workers for temporary or seasonal work. The work must be temporary, and the employer must prove this to the U.S. Department of Labor. This department will determine whether the work is truly temporary or not. The visa allows for a stay of 6-10 months, with the right to extend the visa for up to 3 years.
The work can be either skilled or unskilled. Businesses accepting H-2B workers include those in the landscaping industry (landscapes, lawn care, and golf course maintenance), unskilled workers in the hotel and restaurant service industries, as well as those working at amusement parks and golf clubs (maids, salespeople, managers, waiters, cooks, bartenders, maintenance staff, and ride attendants), and small truck drivers.

I-129 petition receipt number
5 x 5 color photographs without corners or ovals, on a light background, matte finish.
Employment certificate (on company letterhead with signature and seal). The certificate must indicate the position, salary, and start date of employment with the organization.
Documents confirming ties to the home country: certificate of ownership of an apartment, house, land plot, etc.; marriage certificate, birth certificates of children, etc. Proof of sufficient funds for travel – bank statement/credit card and/or credit card statement
Photocopy of your passport (all pages containing information)
